1. About These Terms

These terms of use (“Terms”) govern your access to and use of the phvdrivers.com website and service (“Service”), operated by phvdrivers.com, a trading name of Mobility Exchange Ltd (company number 16766811), registered at 124 City Road, London, England, EC1V 2NX (“we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. What the Service Does

phvdrivers.com is a technology platform that enables licensed PHV operators to submit requests for overflow driver capacity. The Service facilitates introductions between operators who have overflow demand and licensed drivers who have indicated their availability.

The Service is a communication and matching tool only. We do not provide transport services, employ or engage drivers, dispatch vehicles, or act as a PHV operator or hackney carriage proprietor.

3. No Guarantee of Availability

We do not guarantee that drivers will be available in your area at any given time. We make no representation or warranty that:

  • any driver will be available to fulfil a booking request;
  • a booking request will be accepted within any particular timeframe;
  • the Service will be available in your licensing area at any particular time; or
  • the platform will be free from interruptions, errors, or downtime.

The Service is provided on an “as is” and “as available” basis.

4. Your Responsibilities

PHV Operators

  • You hold a valid PHV operator’s licence and will maintain it for as long as you use the Service.
  • All booking arrangements made through the Service are between you and the driver directly.
  • You are responsible for ensuring all bookings comply with your operator’s licence and local authority licensing conditions.
  • You remain responsible for all regulatory, licensing, and legal obligations associated with bookings, including record-keeping, insurance, and complaints handling.
  • You will not use the Service for any unlawful purpose or in breach of your licensing conditions.

PHV Drivers

  • You hold a valid PHV driver’s licence and badge issued by the relevant local authority.
  • You are responsible for ensuring all work undertaken via the Service complies with your licensing conditions and applicable legislation.
  • Any arrangement with an operator identified through the Service is between you and that operator directly.

5. Relationship Between Parties

We are not a party to any booking, contract, or arrangement between an operator and a driver. We act solely as a technology intermediary. We do not:

  • employ, contract, manage, or supervise any driver on the platform;
  • set fares, prices, or terms for any booking;
  • accept any booking on behalf of any party;
  • act as agent for any operator, driver, or passenger; or
  • assume any responsibility for the performance, conduct, or suitability of any driver.

6. Driver Verification

Drivers have been verified as holding a valid licence at the time of registration. However:

  • We are not a licensing authority and do not conduct DBS checks, medical assessments, or vehicle inspections.
  • Licence status can change at any time. We cannot guarantee a driver’s licence remains valid at the point a booking is accepted.
  • It remains your responsibility to satisfy yourself that any driver you engage holds a valid licence at the time of booking.

7. Fees + Payment

Registration on the phvdrivers.com waiting list is free. When the Service becomes operational in your area, fees may apply. We will notify you in advance of any charges before you are required to pay anything.

8. Intellectual Property

All content on phvdrivers.com, including text, design, logos, and software, is the property of phvdrivers.com or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any loss, damage, or expense arising from any booking, journey, or arrangement made between parties introduced through the Service.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the total fees paid by you in the twelve months preceding the claim, or £100, whichever is greater.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold harmless phvdrivers.com, its directors, officers, and employees from any claims, losses, damages, and expenses arising from your use of the Service or breach of these Terms.

11. Suspension + Termination

We may suspend or terminate your access at any time if we believe you have breached these Terms or your licensing status has changed. You may stop using the Service at any time by contacting team@phvdrivers.com.

12. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify you by email where possible. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
